Terms of service

This Terms of Use (hereinafter referred to as the "Agreement") sets forth the terms and conditions of use of the online shop (hereinafter referred to as the "Service") provided by WEAR-2.5 WEB STORE (hereinafter referred to as the "Shop") on this website. Users (hereinafter referred to as "Users") who have registered for the Service shall use the Service in accordance with this Agreement.

Article 1 (Application)

This Agreement shall apply to all relationships related to the use of the Service between the User and the Shop. The Shop may establish various provisions (hereinafter referred to as "Individual Provisions"), such as rules for use, in addition to this Agreement regarding the Service. Regardless of their name, these Individual Provisions shall constitute a part of this Agreement, unless otherwise specified in the Individual Provisions, and in the event of any inconsistency between the provisions of this Agreement and those of the Individual Provisions, the provisions of the Individual Provisions shall prevail, unless otherwise specified in the Individual Provisions.

    Article 2 (Management of User ID and Password)

    In the Service, those who wish to register shall apply for registration in accordance with the method prescribed by the Shop after agreeing to this Agreement, and registration shall be completed when the Shop notifies the applicant of its approval. The Shop may not approve the registration application if it determines that the applicant has any of the following reasons, and shall not be obliged to disclose the reason for such non-approval.
    1. If false information is provided in the application for registration
    2. If the applicant has violated this Agreement in the past
    3. For any other reason that the Shop deems the registration to be inappropriate

      Article 3 (Use Registration)

      The User shall manage their user ID and password for the Service at their own responsibility.

      The User shall not transfer or lend their user ID or password to a third party, or share them with a third party under any circumstances. If a combination of a user ID and password matches the registration information and is logged in, the Shop shall consider it as use by the User who registered the user ID. The Shop shall not be liable for any damages caused by the use of a user ID and password by a third party, except in cases where the Shop has intentional or gross negligence.

        Article 4 (Sales Contract)

        With regard to this service, a sales contract shall be deemed to have been formed when a user applies for a purchase from our store and our store notifies the user that the application has been accepted. The ownership of the product shall transfer to the user when our store delivers the product to the shipping company.

        Our store may cancel the sales contract without prior notice to the user if any of the following apply:

        1. The user has violated these terms and conditions
        2. The product cannot be delivered due to unknown delivery destination or long-term absence
        3. Other circumstances that damage the trust relationship between our store and the user

        Separate methods established by our store shall apply for payment methods, delivery methods, cancellation methods for purchase applications, return methods, and other matters related to this service.

        Article 5 (Intellectual Property Rights)

        The copyright or other intellectual property rights to the contents, including product photos, provided by this service (hereinafter referred to as the "Contents") belong to the legitimate rights holders such as our store and content providers, and users are not allowed to replicate, reproduce, modify, or use them for any other purpose without permission.

        Article 6 (Prohibited Acts)

        Users shall not engage in the following acts when using this service.

        1. Acts that violate laws or public morals
        2. Acts related to criminal activities
        3. Acts that infringe upon the copyrights, trademark rights, or other intellectual property rights included in this service
        4. Acts that damage or obstruct the function of our store's servers or networks
        5. Acts that use information obtained through this service for commercial purposes
        6. Acts that may interfere with the operation of our store's service
        7. Unauthorized access or attempted unauthorized access
        8. Acts of collecting or storing personal information of other users
        9. Impersonation of other users
        10. Acts that directly or indirectly provide benefits to anti-social forces related to our store's service
        11. Other acts deemed inappropriate by our store

        Article 7 (Suspension of Service Provision)

        The shop may suspend or interrupt the provision of all or part of the services without prior notice to the user if any of the following reasons are determined:

        1. To conduct maintenance or updates on the computer system related to the services
        2. In the event that the provision of the services becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
        3. In the event of a computer or communication line failure due to an accident
        4. Any other reason in which the shop deems the provision of the services difficult

        The shop shall not be liable for any disadvantages or damages incurred by users or third parties due to the suspension or interruption of the service provision, regardless of the reason.

        Article 8 (Limitation of Use and Deletion of Registration)

        The shop may restrict all or part of the user's use of the service or delete the user's registration without prior notice if any of the following apply:

        1. The user violates any provisions of these Terms and Conditions
        2. False facts are found in the registered information
        3. The user's credit card, which has been reported as the payment method, has been suspended
        4. The user fails to fulfill any payment obligation
        5. The user does not respond to the shop's contact for a certain period of time
        6. There has been no use of the service for a certain period of time since the last use
        7. The shop deems the use of the service inappropriate for any other reason

        The shop shall not be liable for any damages incurred by the user due to actions taken by the shop based on this Article.

        Article 9 (Withdrawal)

        The user may withdraw from the service by following the prescribed withdrawal procedure.

        Article 10 (Disclaimer of Warranties and Limitation of Liability)

        The Shop does not guarantee that the Service is free of defects, whether factual or legal (including defects related to safety, reliability, accuracy, completeness, validity, suitability for specific purposes, security, errors, bugs, infringement of rights, and the like). The Shop shall not be liable for any damages suffered by the User arising from the use of the Service. However, if the contract between The Shop and the User concerning the Service (including these Terms and Conditions) constitutes a consumer contract as defined in the Consumer Contract Act, this disclaimer shall not apply. Nevertheless, The Shop shall not be liable for damages suffered by the User arising from any breach of contractual obligations or tortious acts attributable to The Shop's negligence (excluding gross negligence) with regard to damages arising from special circumstances (including cases where The Shop or the User could foresee the occurrence of the damage in question or could have foreseen it). The Shop shall not be responsible for any transaction, communication, or dispute that occurs between the User and other users or third parties regarding the Service.

        Article 11 (Modification of the Service, etc.)

        The Shop may modify the content of the Service or suspend its provision without prior notice to the User, and shall not be liable for any damages suffered by the User as a result of such modification or suspension.

        Article 12 (Amendment to these Terms and Conditions)

        The Shop may amend these Terms and Conditions without prior notice to the User if it deems it necessary. If a User starts using the Service after these Terms and Conditions have been amended, it shall be deemed that the User has agreed to the amended terms and conditions.

        Article 13 (Handling of Personal Information)

        The Shop shall handle any personal information obtained through the use of the Service appropriately in accordance with The Shop's Privacy Policy.

        Article 14 (Notice or Contact)

        Notifications or contacts between the user and the shop shall be made in the manner specified by the shop. Unless the user provides the shop with a change of contact information using the method designated separately by the shop, any notification or contact to the currently registered contact information shall be deemed valid and reached the user at the time it was sent by the shop.

        Article 15 (Prohibition of Assignment of Rights and Obligations)

        The user shall not assign or pledge the position or rights or obligations based on this agreement to a third party without the prior written consent of the shop.

        Article 16 (Governing Law and Jurisdiction)

        Japanese law shall be the governing law for the interpretation of this agreement. Disputes related to this service shall be exclusively resolved by the court having jurisdiction over the shop's headquarters as the exclusive agreement jurisdiction court.
